4. Data and Privacy

5. Payment Terms

Service fees are based on your customized plan and are billed monthly. Payment terms include:

• Fees are due within 30 days of invoice
• Late payments may result in service suspension

6. Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for service interruptions due to factors beyond our control, including but not limited to internet connectivity, third-party integrations, or force majeure events.

7. Limitation of Liability

Nytforge Business shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

8. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, you will have access to export your data for 90 days. We reserve the right to suspend or terminate service immediately for violation of these terms or non-payment.

9. Intellectual Property

Nytforge Business retains all rights to our AI technology, software, and platform. You retain ownership of your business data, product catalogs, and customer information. You grant us a limited license to use your data solely for providing the contracted services.

10. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective 30 days after posting to our website or notification to your registered email address. Continued use of the service constitutes acceptance of modified terms.
